Huawei says it welcomes Swedish court's decision to proceed with the appeal on the 5G ban and is still commit to local market

Huawei said it welcomes the decision from a Swedish court of proceeding with the appeal on the ban on the company to sell 5G gear, a move that may help it stage a comeback in the European country where major rival Ericsson is headquartered amid the US crackdown.

"The Administrative Court of Appeal of Stockholm has announced that Huawei is granted leave to appeal in the case regarding the Swedish 5G license conditions. Huawei welcomes the decision […] and looks forward to the important issues of principle in the case now being reviewed by a higher court," the firm said in a statement shared with the Global Times.

"We consider ourselves to have a well substantiated legal argumentation which is supported by a number of leading academics, as well as strong evidence, and are now looking forward to the Administrative Court of Appeal's review," said Kenneth Fredriksen, Executive Vice President for Central East Europe and Nordic Regions at Huawei, adding that, "while the court process is underway, we will continue to build a digital Sweden together with our customers and partners."

On October 20 last year, the Swedish Post and Telecom Authority (PTS) announced that products from Huawei may not be used in the Swedish 5G networks - a ban means that the company is excluded from the Swedish market for network equipment and services to 5G networks in the coming 25 years.

Huawei challenged the decision in the court while the Administrative Court of Stockholm later in June decided to uphold the ban.

However, the Administrative Court supported Huawei's position that the PTS had violated the law by not complying with its duty to communicate with Huawei at all prior to these far-reaching decisions. 

Huawei appealed the judgment to the Administrative Court of Appeal in July and supplemented the proceedings with full argumentation and evidence on September 30. 

Sweden's Huawei ban was widely considered as a "political move." A source told the Global Times in a previous report that the Chinese government has repeatedly urged Sweden to correct its wrong decisions and provide an open, equitable, fair and non-discriminatory business environment, thereby avoiding a negative impact on China-Sweden economic and trade cooperation, and Swedish businesses' operations in China. However, Sweden, instead of stopping its wrongful actions, has been arbitrarily walking even farther along the wrong path.
