The Ministry of Commerce (MOFCOM) has decided to initiate a sunset review investigation on the countervailing measures applicable to imported solar-grade polysilicon originating from the US, starting from January 14, 2025, MOFCOM announced on Friday.
This review investigation is to determine whether terminating the countervailing measures implemented on imported US solar-grade polysilicon might result in continued or renewed subsidization and harm to the domestic industry.
During the period of the final review investigation, the countervailing duties on imported US solar-grade polysilicon will remain in effect based on the scope of taxable products and tax rates set by MOFCOM in 2014 and 2020.
The countervailing duty rate imposed on Hemlock Semiconductor Corporation and AE Polysilicon Corporation is 2.1 percent; REC Solar Grade Silicon LLC, REC Advanced Silicon Materials LLC, and MEMC Pasadena face a 0 percent duty rate, while other US companies are subject to a 2.1 percent duty.
The subsidy investigation period for this review is from January 1, 2024, to December 31, 2024, and the period for the investigation of industry damage is from January 1, 2020, to December 31, 2024, according to the announcement.
On the same day, MOFCOM additionally announced it decided to launch a sunset review investigation on the anti-dumping measures applicable to imported solar-grade polysilicon originating from the US and South Korea, starting from January 14, 2025.
This review investigation is to determine whether the termination of anti-dumping measures on imported solar-grade polysilicon from the US and South Korea might result in continued or renewed dumping and harm.
During the period of the final review investigation, anti-dumping duties on imported solar-grade polysilicon from the US and South Korea will continue to be levied in accordance with the scope of taxable products and tax rates announced in 2014, 2017, and 2020.
The anti-dumping duty rate imposed on US REC Solar Grade Silicon LLC, REC Advanced Silicon Materials LLC and AE Polysilicon Corporation is 57 percent; that of Hemlock Semiconductor Corporation reached 53.3 percent and MEMC Pasadena, 53.6 percent. The duty rate of other US companies is 57 percent.
In terms of South Korean enterprises, the anti-dumping duty rate imposed on OCI Company is 4.4 percent, Hankook Silicon Co., 9.5 percent and SMP, 88.7 percent. That of Woongjin Polysilicon Co., KAM Corp and Innovation Silicon Co. is 113.8 percent. The duty rate for other South Korean companies stands at 88.7 percent.
